Patents of Invention

Protects a novel invention that allows, in practice, the solution of a given problem in the field of technology. It must be New (in the sense that it has not been published or used publicly at a National or International level), Non-obvious and Applicable in Industry. The benefits of its protection have to do with the security of the protection itself and the economic gain from exploitation by third parties.

Inventions are protected by property titles. These titles protect the product of inventive activities with industrial application by means of the Patent of Invention.

It confers on the owner a monopoly on the industrial and commercial exploitation of the patented invention for 20 years against payment of the corresponding annual fee.

In order for an invention to be patentable, according to the Patent Law, it has to be:

  • Absolute novelty at national and world level.
  • be the result of an inventive step, providing a solution to a technical problem which is not obvious to experts.
  • Be industrial in nature.
