Utility Models
The Utility Model is very similar to a patent, its requirements are less strict and it is commonly granted on minor innovations.
Innovations in known tools, working instruments, implements, utensils, devices or objects which lend themselves to practical work shall be protected by the Utility Model.
Mechanical innovations, process improvements or adaptations of a product that has already been patented.
It has a duration of 10 years.
This deadline cannot be extended.
To obtain a Utility Model according to the Utility Model Law it has to be:
- New at National level and have an Industrial Character.
- It shall not be an impediment if they lack Inventive Activity or if they are known or disclosed abroad.
A Utility Model search may be carried out in the INPI database.
